1. About HeyHushly

HeyHushly is an AI-powered companion chat platform that allows users to interact with artificial intelligence companions through text and other supported features. Some areas of the Service may contain Mature (18+) content intended only for adults.

AI companions are fictional, automated systems generated by software and are not real people.

2. Eligibility & Age Requirements

You must be at least 18 years old to use the Service.

By using HeyHushly, you confirm that:

• • You are legally capable of entering into a binding agreement;
• • You are not prohibited from using the Service under applicable laws.

We reserve the right to suspend, restrict, or permanently terminate accounts we reasonably believe belong to underage users or users providing false information.

6. User Content

You may submit messages, prompts, text, images, profile information, and other content (“User Content”).

You retain ownership of your User Content. However, by using the Service, you grant us a worldwide, non-exclusive, royalty-free licence to host, process, store, reproduce, and use your content solely for:

9. Subscriptions, Billing & Payments

By purchasing a subscription, you agree that:

• • Failure to pay may result in suspension or loss of access to premium features.

We may suspend, restrict, or terminate access to the Service immediately if:

• • Emotional distress or psychological harm;
• • Service interruptions, outages, bugs, or security incidents;
• • Unauthorized access to accounts or data;
• • User-generated or AI-generated content;
• • Emotional distress or reliance on AI-generated content;
• • Damages arising from use or inability to use the Service.

Where liability cannot legally be excluded, our total liability shall be limited to the amount paid by you to the Service in the 12 months preceding the claim.

Nothing in these Terms excludes liability that cannot legally be excluded under applicable law.

16. Indemnification

You agree to indemnify and hold harmless HeyHushly, XRTX, affiliates, employees, and partners from claims, damages, liabilities, and expenses arising from:
